Kinosura Creative Studio is referred to below as the “Studio”, and the natural or legal person making the booking as the “Renter”.

By making a booking, the Renter confirms that they have read and accepted these Terms.

1. SUBJECT OF THE RENTAL

1.1. The Studio grants the Renter temporary use of the Kinosura Creative Studio premises for the confirmed booking period.

1.2. The rental price includes the use of equipment, furniture and ordinary props that are stated on the website at the time of booking as being included in the relevant rental type.

1.3. The primary purpose of the Studio is photography and video production.

Use of the Studio for workshops, events, teaching, meetings, castings, presentations or other purposes is permitted only if agreed with the Studio in advance.

1.4. Subletting, reselling a booking or transferring the Studio for independent use by a third party without the Studio’s prior consent is prohibited.

2. BOOKING AND FORMATION OF THE AGREEMENT

2.1. The Studio operates by advance booking.

2.2. When making a booking, the Renter selects the date, time, duration and, where applicable, additional services.

2.3. The agreement is formed once the booking has been confirmed and payment has been received, or when the Studio has provided separate written confirmation if the parties have agreed on another payment arrangement.

2.4. The minimum duration of a standard rental is two hours unless expressly stated otherwise for a particular service or offer.

2.5. After receiving the booking confirmation, the Renter must check the date, time, duration and other material booking details and notify the Studio without undue delay of any error discovered.

2.6. The Studio may request additional information about the nature of the planned shoot, the number of participants, equipment to be used or other circumstances where this is necessary for the safety of the premises, persons or property.

3. PRICE AND PAYMENT

3.1. The rental price is the price displayed on the website or in the booking system at the time the order is placed.

3.2. Unless expressly stated otherwise, consumer prices include the applicable value-added tax.

3.3. A change in the price list after a booking has been confirmed does not change the price of that confirmed booking.

3.4. Additional services, consumables and use of property not included in the selected rental type are charged separately.

3.5. Any used or damaged portion of a paper backdrop is charged at the price published and applicable at the time of booking.

3.6. Corporate and professional customers may, by prior agreement, be offered payment by invoice.

3.7. For certain types of shoots, unusual use of the premises or use of particularly valuable equipment, the Studio may require a security deposit, provided that the amount and terms of the deposit have been communicated to the Renter before the relevant booking is confirmed.

4. RENTAL PERIOD

4.1. The booked period includes the entire period of Studio use, including:

— preparation of the premises and equipment;

— lighting setup;

— make-up and changing clothes;

— the shoot itself;

— dismantling equipment;

— cleaning;

— returning furniture, equipment and props to their original positions.

4.2. The Renter and persons invited by the Renter must leave the Studio by the end of the booked period.

4.3. Late arrival by the Renter or persons invited by the Renter does not extend the booking period and does not reduce the rental price.

4.4. An extension is possible only with the Studio’s consent and provided that there is no subsequent booking preventing it.

4.5. If access to the Studio is delayed for a reason within the Studio’s control, the Renter will be given corresponding additional time or an appropriate proportional price adjustment.

5. EQUIPMENT

5.1. Before using equipment with which the Renter is unfamiliar, the Renter must review the available instructions or request guidance.

5.2. The Renter is responsible for assessing whether the Studio’s equipment is suitable for the Renter’s particular creative or technical purpose.

5.3. The Studio does not guarantee compatibility of Studio equipment with the Renter’s cameras, lenses, radio trigger systems, software or other equipment unless such compatibility has been expressly agreed in advance.

5.4. If a fault is detected, use of the relevant equipment must stop and the Studio must be informed.

5.5. The Renter may not dismantle, repair, modify or open Studio equipment.

5.6. The Renter is responsible for the proper use of equipment by all persons whom the Renter allows to use it during the booking.

6. RULES FOR USE OF THE STUDIO

6.7. The presence of animals must be agreed in advance.

6.8. Food and drinks may be consumed in the designated area. Their use directly in the shooting area is permitted only where there is no risk of soiling or where agreed with the Studio.

6.9. At the end of the rental, equipment, furniture and props must be returned to their designated places.

6.10. The Renter must remove all materials, props, packaging and waste brought into the Studio.

7. PARTICIPANTS IN THE SHOOT

7.1. The Renter is responsible for all persons whom the Renter invites or permits to enter the Studio in connection with the booking.

7.2. The Renter must ensure that persons invited by the Renter are familiar with the applicable safety and Studio-use rules.

7.3. A breach of the rules by a person invited by the Renter is treated as a breach by the Renter.

7.4. To the extent permitted by law, the Renter is responsible for damage caused to the Studio by the Renter or by persons invited by the Renter.

7.5. Minors must be under the appropriate supervision of an adult responsible for them.

8. SAFETY AND THE RIGHT TO STOP A SHOOT

8.1. The Renter must comply with fire, electrical and general safety requirements and with equipment instructions.

8.2. Exits, passageways and access to safety equipment must not be obstructed.

8.3. Unusual structures, suspension of heavy objects, use of large quantities of liquids, fire, smoke, animals or other potentially hazardous activities must be agreed in advance.

8.4. The Studio may require the immediate cessation of any activity that:

— endangers a person;

— may damage the premises or property;

— violates the law;

— violates building rules;

— materially breaches these Terms.

8.5. In the event of a material breach of the rules or refusal to comply with a reasonable safety instruction, the Studio may terminate the rental and require the Renter and other persons to leave the premises.

If the rental is terminated because of a material breach by the Renter or persons invited by the Renter, unused time will not be compensated to the extent permitted by applicable law.

9. DAMAGE TO THE PREMISES AND EQUIPMENT

9.1. The Renter is responsible for damage caused by misuse of property, negligence or breach of these Terms by the Renter or persons invited by the Renter.

9.2. Normal wear and tear is not considered damage.

9.3. If property is damaged, the Studio may claim reimbursement of reasonable and verifiable costs relating to:

— diagnosis;

— cleaning;

— repair;

— restoration;

— or replacement where repair is impossible or economically unreasonable.

9.4. If additional cleaning of the premises is required because of the actions of the Renter or persons invited by the Renter, the Studio may claim reimbursement of the reasonable costs actually incurred for such cleaning.

9.5. Any damage discovered must be reported to the Studio without undue delay.

10. PERSONAL BELONGINGS AND PROPERTY OF THE RENTER

10.1. The Renter and persons invited by the Renter are responsible for the safekeeping of their own cameras, lenses, computers, phones, memory cards and other storage media, clothing, props, documents and other personal property.

10.2. The Studio does not provide storage or security services for the Renter’s property.

10.3. The Studio is not liable for loss, theft or damage to unattended property except where such liability follows directly from mandatory law.

10.4. The Studio is not liable for loss of or damage to the Renter’s digital files, photographs, videos, data or storage media.

11. RESULT OF THE SHOOT

11.1. Rental of the Studio means provision of access to the premises and agreed equipment and is not a guarantee of any particular photographic, artistic, technical or commercial result.

11.2. The Renter is responsible for the choice of equipment and settings, lighting setup, exposure, focusing, sound recording, storage of material, work with models and other creative and technical decisions.

11.3. The Studio does not guarantee that any particular number of usable photographs or amount of video material will be produced.

11.4. Assistance or recommendations provided by a Studio representative do not mean that the Studio accepts responsibility for the final result of the shoot.

12. RESPONSIBILITY FOR PRODUCTION AND THIRD PARTIES

12.1. The Renter independently organises the shoot and relationships with all persons involved.

12.2. The Studio is not a party to arrangements between the Renter and models, make-up artists, stylists, assistants, clients, actors, camera operators, couriers, transport companies or other third parties.

12.3. The Studio is not responsible for their lateness, failure to attend, refusal to participate, quality of work or other conduct.

12.4. The Renter is responsible for obtaining any required consents, permissions and model releases and for rights relating to works, music, trademarks, props and other materials used in the shoot.

13. LIMITATION OF THE STUDIO’S LIABILITY

13.1. To the extent permitted by mandatory law, the Studio is not liable for loss or damage arising from:

— acts or omissions of the Renter or persons invited by the Renter;

— misuse of equipment;

— incompatibility of equipment;

— insufficient skills of the Renter;

— absence or conduct of participants in the shoot;

— loss of material or data;

— failure to achieve an expected creative or commercial result;

— costs incurred by the Renter in organising the shoot.

13.2. The Studio does not guarantee the availability of a particular parking space, the quality of mobile connectivity, the operation of third-party equipment or services, or other services not expressly included in the confirmed booking.

13.3. These limitations do not apply to the extent that liability cannot be excluded or limited under mandatory law.

14. ADDITIONAL LIMITATIONS FOR BUSINESS AND PROFESSIONAL CUSTOMERS

14.1. This section applies where the Renter enters into the agreement primarily in connection with their business, professional or other commercial activity.

14.2. To the maximum extent permitted by law, the Studio is not liable to such a Renter for:

— indirect or consequential loss;

— loss of profit;

— loss of turnover or revenue;

— loss of a customer or contract;

— reputational damage;

— model, staff, travel, accommodation or production costs;

— the cost of a repeat shoot;

— loss of digital material or data.

14.3. Except in cases of wilful misconduct, gross negligence or other liability that cannot lawfully be limited, the Studio’s total contractual liability to a professional Renter is limited to the amount actually paid for the relevant booking.

15. CANCELLATION AND RESCHEDULING

15.1. The booking is subject to the Kinosura Creative Studio Cancellation and Rescheduling Policy that was in force and available to the Renter at the time of booking.

15.2. Unless otherwise agreed:

— if cancelled no later than 72 hours before the rental begins, the payment will be refunded;

— if cancelled 24–72 hours before the rental begins, the payment is non-refundable, but the booking may be rescheduled once free of charge to another available time within 60 days;

— less than 24 hours before the rental begins, the payment is non-refundable and no free rescheduling is available.

15.3. Failure to attend without prior notice is treated as a cancellation made less than 24 hours before the start time.

15.4. Detailed rules concerning cancellations, rescheduling and exceptional circumstances are set out in the separate Cancellation and Rescheduling Policy.

16. CONSUMER RIGHT TO WITHDRAW FROM A DISTANCE CONTRACT

16.1. If the Renter is a consumer, the mandatory provisions of Finnish consumer protection law apply.

16.2. The ordinary 14-day right to withdraw from a distance contract does not apply where the particular booking falls within a statutory exception concerning a leisure service to be provided on a specific date or during a specific period.

16.3. If the particular booking does not fall within such an exception, the consumer’s mandatory statutory rights apply.

17. CANCELLATION BY THE STUDIO

17.1. If the Studio cannot provide a confirmed booking for a reason within the Studio’s control, the Studio may offer the Renter another suitable time.

17.2. If the Renter does not accept the rescheduling, the price of the service not provided will be refunded.

17.3. A refund of the booking price does not limit any other mandatory consumer rights that may arise in the particular circumstances.

18. CIRCUMSTANCES OUTSIDE THE STUDIO’S CONTROL

18.1. The Studio is not liable for failure or delay in performing its obligations where caused by circumstances outside its reasonable control and whose consequences could not reasonably have been avoided.

18.2. Such circumstances may include, for example:

— damage to or technical failure of the building;

— interruption of electricity, water or heating;

— fire;

— an emergency situation;

— an official prohibition or restriction;

— another comparable event.

18.3. Where such circumstances occur, the Studio and the Renter will, where possible, seek to agree on rescheduling the booking.

18.4. If provision of the service becomes impossible, any refund will be determined in accordance with mandatory law and the portion of the service that was not provided.

19. PERSONAL DATA

19.1. The Studio processes the Renter’s personal data for the purpose of making and performing the booking.

19.2. The data may be used, among other purposes, for processing the booking, communicating with the Renter, payment, accounting and invoicing, compliance with legal obligations, and handling complaints and potential claims.

19.3. Further information is provided in the Kinosura Privacy Notice.

20. COMPLAINTS

20.1. If the Renter considers that the service does not correspond to what was agreed, the Renter must notify the Studio of the issue without undue delay after discovering it.

20.2. Complaints may be sent to studio@kinosura.fi.

20.3. Where possible, the Renter should provide information enabling the circumstances of the complaint to be established.

21. GOVERNING LAW AND DISPUTE RESOLUTION

21.1. These Terms are governed by the laws of Finland.

21.2. The parties will first seek to resolve any dispute through negotiations.

21.3. A consumer may contact Consumer Advisory Services (Kuluttajaneuvonta) and, where applicable, submit the dispute to the Consumer Disputes Board (Kuluttajariitalautakunta).

21.4. These Terms do not restrict the consumer’s right to bring a matter before a competent court in the circumstances and venue permitted by mandatory law.

21.5. Disputes with Renters acting in the course of business or professional activity will be heard by a competent court in Finland unless the parties have agreed in writing on another lawful dispute resolution procedure.

22. SEVERABILITY

22.1. If any provision of these Terms is held to be invalid, unenforceable or contrary to mandatory law, this does not in itself affect the validity of the remaining provisions.

22.2. In that case, the relevant provision will be applied to the maximum extent permitted by law or replaced by the applicable provision of law.
