Terms and Conditions of Sale

1. Definitions and Scope

1.1. ”Seller” means Kinosura Creative Studio, Business ID 2 677 199-8.
1.2. ”Buyer” means any person who purchases photographs via the website.
1.3. These Terms apply to all orders placed through the website’s photo gallery powered by Wfolio.

2. Formation of the Contract

2.1. The display of photographs in the online gallery is an invitation to make an offer.

2.2. A Buyer’s offer is made by clicking the ”Buy” button and completing the order form.

2.3. The contract is concluded when the Seller sends an order confirmation email to the Buyer.

2.4. No registration is required: the Buyer may complete the order by providing contact details in the order form.

3. Pre-Contractual Information

3.1. Before confirming the order, the Buyer is provided with:

• Preview images in low resolution with a watermark
• Unit price and total price, including VAT 25.5% and any payment processing fees
• Delivery method: immediate download link after payment
• Seller’s contact and billing information
• Purchased digital photographs are delivered with a resolution of at least 3000 DPI on the longest side

4. Price and Payment

4.1. All prices are in EUR and include VAT 25.5% and Stripe processing fees.

4.2. Payment is processed via Stripe. The Buyer will be redirected to Stripe’s secure payment page.

4.3. The contract price is charged to the Buyer’s chosen payment method upon order confirmation.

5. Delivery and Access to Photographs

5.1. Delivery of digital photographs occurs immediately by displaying a secure download link after payment.

5.2. After purchase, access to the photographs is only possible via the provided download link. Copy and save this link before closing the payment window, as there is no registration or account feature on the website.

6. Right of Withdrawal

6.1. The 14-day right of withdrawal does not apply to digital downloads that begin immediately after payment (exemption under Section 16 of the Finnish Consumer Protection Act).

6.2. No physical products are offered on the website, so the right of withdrawal does not apply.

7. Liability

7.1. The Seller is liable for intentional misconduct or gross negligence.

7.2. Liability for minor negligence is excluded, except in cases of personal injury or breach of essential contractual obligations.

8. Applicable Law and Dispute Resolution

8.1. These Terms are governed by Finnish law.

8.2. Any disputes arising from the contract shall be resolved by the competent courts of Finland.
